On New Philanthropy, Education Reform, and Eli Broad’s Big Plan for L.A. Schools

The Los Angeles Times published a confidential document yesterday, which seems to confirm earlier reports that the Broad Foundation wants at least 50 percent of L.A. public school students educated in charter schools over the next eight years. Currently, 16 percent of students in L.A. Unified attend charters, and according to the report, getting to 50 percent would require creating 260 new schools, for 130,000 students, at a cost of $490 million.

“Los Angeles is uniquely positioned to create the largest, highest-performing charter sector in the nation,” the report stated. “Such an exemplar would serve as a model for all large cities to follow.”

Hmmm. That sounds familiar.

Earlier this month, veteran Washington Post journalist Dale Russakoff published a new book, The Prize, which explores education reform efforts in Newark from 2010-2015. Her book details the goals, mistakes, and challenges reformers encountered as they tried to “transform” Newark’s struggling school system—largely through expanding charters, closing “failing” schools, and implementing new teacher pay scales. The political drama and backroom dealings led by New Jersey Governor Chris Christie, Newark Mayor Cory Booker, and Facebook CEO Mark Zuckerberg offers humbling lessons to all those working to improve public education, no matter where one comes down on the policy specifics.

Like Eli Broad’s vision for Los Angeles, a key goal for Newark education reformers was to make the city a model for the rest of urban America. Booker wanted Newark to be transformed into “a hemisphere of hope” and repeatedly told Zuckerberg that their goal was not just to fix local education, but to develop the “high impact programs and best practices” that could fix education in all major cities. Booker believed that if he could succeed within a difficult district like Newark, then he could succeed anywhere. He emphasized that Zuckerberg’s investment could help lead to the “blueprint for national replication across America’s urban centers to transform its youth.”

This month, HistPhil, a blog that explores the history of the philanthropic and nonprofit sectors, has been running an excellent series on philanthropic involvement in education. Their effort is well timed: As billionaires like Mark Zuckerberg, Bill Gates, and Eli Broad continue to pour hundreds of millions of dollars into education reform, the need to understand what’s historically new, and what’s not, is more important than ever.

Sarah Reckhow, a political scientist and author of Follow the Money: How Foundation Dollars Change Public Schools, contributed to the HistPhil series by looking specifically at Mark Zuckerberg’s experiment in Newark. Reckhow notes that there exists a “perennial drive” for philanthropists to create national reform models. She points to the Ford Foundation’s Gray Areas program in the 1960s, an effort that philanthropists had hoped could serve as a national model for urban policy. “The fallacy of the national replication model—at the expense of truly listening and understanding local circumstances—is a lesson that philanthropists must relearn time and again,” Reckhow says.

Other cities experimenting with education reform are similarly interested in “scaling” their efforts. Many point to the academic gains seen in New Orleans—the urban district with the highest percentage of charter schools in the country—as reason to implement their reforms elsewhere. “We don’t know if similar efforts can be replicated in other cities,” argued Neerav Kingsland, a prominent New Orleans reformer. “But we owe it to the children of this country to try and find out.” Tulane economist Doug Harris, who has conducted the most rigorous research on New Orleans reforms to date, says it’s questionable whether their model would work in other cities given the unique economic and political conditions present in New Orleans after Hurricane Katrina.

OK, so reformers and philanthropists are drawn to ideas that can scale—and apparently have been for a long time. Still, how should we be thinking about Eli Broad’s plan to “charterize” L.A.? Is there anything new about today’s crop of philanthropists? Several contributors to the HistPhil blog argue yes.

Sociologist Robin Rogers says that the ideas held by modern philanthropists reflect those commonly seen in the venture capital world. She cites an influential article from 1997 in The Harvard Business Review that encouraged philanthropists to pursue social change using tactics commonly employed in the business sector. “Considered to be more muscular than traditional approaches to philanthropy, the new philanthropy appeals to many men who made money in tech or finance sectors,” Rogers writes. “These (primarily) men have great faith in the tools and techniques that they used to disrupt the old economy and usher in the new one.”

While modern philanthropists share some similarities with their rich predecessors, Rogers argues that today’s bunch are far more likely to focus on “institutional pressure points” rather than provide support for a diverse set of projects. (She points to the Gates Foundation’s involvement in promoting the Common Core standards as an example, as well as dogged support for expanding charter schools).

Jeffrey W. Snyder, a postdoctoral research fellow in education, philanthropy, and advocacy at the University of Michigan and Michigan State University, also wrote a HistPhil post exploring differences between “old” and “new” philanthropy—specifically in terms of their priorities and philanthropic methods. For one thing, Snyder finds that “new foundation granting in recent years far surpasses the total given by old foundations.”

He also says that newer foundations do indeed have different priorities compared to older ones. The latter tends to give substantially to university-based programs and research that aims to improve existing educational systems, while newer foundations donate heavily to charter schools and other organizations that push for more radical change.

We don’t yet know what’s going to happen with Eli Broad’s plan to “reach 50 percent charter market share” within Los Angeles public schools. And it wouldn’t be fair to assume he’ll behave just as Mark Zuckerberg did in Newark, or as other billionaires have elsewhere. Still, paying attention to historical precedent is important, and there seems to be sufficient reason to be wary. As The Washington Post’s art critic Philip Kennicott wrote just days ago, Eli Broad “is a self-made man…who has also built and burned bridges all across [Los Angeles]. Ask around, and no one seems to like him, though many call him effective…They admire his brilliance, covet his money, fear his power and lament his character, which is described as imperious, egomaniacal and relentless.”

School Choice and the Chaotic State of Racial Desegregation

In 2013, a group of white parents in northeast Arkansas tried to transfer their children out of the predominately black Blytheville School District. Like many low-income, majority-black districts, Blytheville’s schools are struggling: state officials recently labeled two of its schools as “academically distressed.”

That same year, the Arkansas state legislature passed a law allowing students to transfer between school districts, unless their local district still had a federal order to desegregate. Blytheville said it was indeed still under federal mandate, and thus the white parents could not transfer their children out. The parents sued, arguing that Blytheville’s desegregation order had ended decades ago, and that they had a constitutional right to switch districts. In 2014, a district court dismissed the case,and on August 31st, the Eighth U.S. Circuit Court of Appeals upheld the lower court’s decision, ruling that the Constitution doesn’t guarantee public school choice. On September 11th, the plaintiffs filed a petition for rehearing.

Whether or not the parents prevail, the Blytheville legal battle reveals a lot about the confused state of school desegregation six decades after Brown v. Board. While the appellate judges focused on whether the plaintiffs’ claims were matters of constitutional import, they sidestepped on whether Blytheville is, or isn’t, still under federal desegregation. That question will surely be litigated in the future, but as it turns out, it’s a surprisingly difficult one to answer, and not just for Blytheville.

In hundreds of cities nationwide, parents, school officials, and even legal experts have struggled to figure out exactly where districts once under federal desegregation now stand. Decades of bad record keeping and lax federal oversight have significantly undercut the power of court-ordered desegregation, and a growing movement around school choice has made the policy discussions around structural racism even that much more complex.

IN 1989, ARKANSAS passed a school choice law that permitted students to transfer to neighboring districts, depending on their race. “No student may transfer to a nonresident district where the percentage of enrollment for the student’s race exceeds the percentage in the student’s resident district,” the law stated. It was an attempt to both promote school choice while also prevent the resegregation of Arkansas public schools. But in 2012, a federal court ruled the statute unconstitutional under the Fourteenth Amendment. The Public School Choice Act of 2013, passed to replace the 1989 law, allowed students to transfer between districts regardless of race, but placed several new restrictions on transfers. Legislators said that transfers could not result in a net enrollment change of more than 3 percent for each district, and that districts still under federal desegregation can be exempted from the law.

During the 2013-2014 school year, 23 districts, among them Blytheville, claimed exemption from the new Public School Choice Act, out of a total of 232. To claim exemption, districts just had to notify the Arkansas Department of Education that it planned to do so. “There appears to be no process in place for validation of these exemptions, theoretically allowing any district, regardless of history of desegregation, to claim an exemption,” University of Arkansas researchers wrote in a 2013 report. They found that six of the 23 exempted districts did not even cite a specific court case when they notified the state Department of Education. And some cases that districts did cite raised questions of legitimacy or relevancy. Attorneys representing the Blytheville parents, for example, argue that the school district inappropriately cites Brown v. Board of Education, a local desegregation order that was dismissed in 1978, and a voting rights case from 1996.

“State officials, reluctant to tread on the ground of federal litigation, refuse to challenge these claims,” wrote the attorneys in their petition for rehearing filed last week. “Thus, using old federal cases, districts falsely claim unfinished desegregation obligations to nullify state education policy and rights. Citizens cannot intervene in those closed cases to stop this farce.”

I was surprised to hear that Arkansas state officials could not validate districts’ requests for exemption by referring to a comprehensive list of schools still under federal desegregation. Surely this all must be tracked somewhere? But upon further investigation, I learned that determining which districts are still under federal order turns out to be a far messier and legally murky process than I initially understood.

A report published in 2007 by the U.S. Civil Rights Commission found that as of May 2007, the United States remained party to 266 lawsuits with active court-ordered desegregation mandates. “There are, of course, many more such cases to which the United States is not a party, but no comprehensive list of these cases currently exists,” the authors wrote. “Moreover, many cases were initiated in the late 1960s and early 1970s and the original players have either moved on or in some cases passed away. In such instances, not even the school districts understand the scope of the court orders that bind them and little reliable information exists that can provide a complete picture as to the nature of ongoing court-ordered desegregation.”

I reached out to Sean Reardon, a Stanford sociologist who has been tracking the impacts of school districts released from court-ordered desegregation, to learn more about why people can’t seem to agree on whether districts are still under federal mandate.

He said that when researching whether districts were still, or had ever been, under federal desegregation, he and his colleagues learned it was a harder question to answer than they had originally expected. “We’d call up people at school districts and sometimes we’d talk to them, and we’d talk to the lawyer, or the central office administrator, or the secretary, whoever would answer questions, and sometimes even the legal office didn’t seem to really know the answer,” he said. Nikole Hannah-Jones, a journalist, cited similar issues in a 2014 ProPublica investigation, finding that, “officials in scores of school districts do not know the status of their desegregation orders, have never read them, or erroneously believe that orders have been ended.”

With the passage of time, poor record keeping, and a lack of consistent court oversight, many districts had nobody left who really remembered, or cared, what their legal obligations were. “Districts seemed unable to tell us if they were under a court order more often than you would think, or different people would say different things,” Reardon said.

Poor record keeping helps explain some confusion, perhaps even for many of the 23 Arkansas districts that claimed exemption, but it didn’t quite clarify what’s going on with Blytheville—where attorneys do point to a specific case, Franklin v. Board of Directors of Blytheville School Dist. No. 5, as evidence that the district is no longer under federal desegregation. A district judge dismissed Blytheville’s court order in 1978, without appeal. So what exactly is there to debate here?

“There’s also a fuzziness about what it means to be ‘released’,” said Reardon, largely thanks to judicial developments in the early ‘90s. In its Board of Education of Oklahoma City v. Dowell decision, reached in 1991, the Supreme Court created the concept of “unitary status”—a designation that could be applied to districts found to have complied with desegregation orders “in good faith.” Unitary status meant districts could be released once and for all from court oversight, even if resegregation was likely. And one year later, the justices ruled in Freeman v. Pittsthat districts could be released from desegregation in phases, rather than all at once.

“I’ve never gotten a clear understanding of what it means to be ‘unitary.’ I think it’s a slippery concept, it’s harder to nail down,” said Reardon. “I can imagine, based on the people I’ve talked to in different districts that there could be cases where people think they’d been released and some people think they weren’t because they were relying on different criteria and different definitions.”

Blytheville was released from desegregation before the concept of unitary status came about, and this seems to be at the crux of the contemporary legal dispute. In December 2014, U.S. District Judge Kristine G. Baker found Blytheville to still be under desegregation and wrote, “The Court acknowledges plaintiffs’ argument that, for many years after 1978, the BSD did not operate as if it were under a desegregation order or agency mandate. The Court views this as irrelevant to the issue of whether the district court declared, explicitly or implicitly, that the BSD achieved unitary status, and the Court views the district court’s lack of a finding of unitary status as controlling.” In other words, the judge said that without a unitary status designation, Blytheville can’t consider itself released from its desegregation mandate.

BLYTHEVILLE-SPECIFIC QUESTIONS aside, Arkansas legislators are still left trying to craft fair and equitable school choice policies. The 2013 law was updated this year, and the new version requires school districts that seek exemptions to “submit proof from a federal court” that they are entitled to one.

But issues still remain. “Districts must show documentation in the new law, but it’s not actually that effective because no one sorted out what it means to have documentation,” said Gary Ritter, a professor of education policy at the University of Arkansas. “People are still citing Brown v. Board.”

Open-enrollment advocates argue that school choice increases healthy competition between districts, and creates more equitable opportunities for disadvantaged students. They also believe that school choice allows more families to access schools that fit their particular needs.

Critics worry that school choice policies will disproportionately hurt low-income students and racial minorities, since the more advantaged students with the means and ability to leave struggling districts are more likely to do so. Social science researchers have found that segregation and school choice policies are often closely linked. When Minnesota instituted an open-enrollment program in 1988, researchers found that it led to increased segregation, as more white students left racially diverse districts to attend predominately white ones

So far, this has not been a major issue in Arkansas. A University of Arkansas policy brief published in February found there to be “very little change in the percent white enrollment due to school choice” since the 2013 law was enacted.

Open-enrollment advocates also note that however well-intentioned, the current law effectively denies choice to students who attend some of the lowest-performing schools in the state—those who might benefit the most from leaving. Exempted districts have a higher proportion of ethnic and racial minorities, have more students eligible for free or reduced lunch, and have lower student achievement and graduation rates, on average, than non-exempt districts.

However, Arkansas does not guarantee free transportation for all students traveling between districts, which suggests that even if no districts were exempt, low-income students whose parents could not afford to transport them to and from school each day would still be less likely to benefit from interdistrict school choice.

Ritter thinks that the state will have to ultimately be clearer about what qualifies as a meaningful reason for exemption. “We have lawyers at the Arkansas Department of Education (ADE). I get that there is some gray area about what exactly constitutes desegregation, but in my view, the ADE should come up with a set of rules, apply those set of rules, and generate a list. And maybe it needs to go to a court and the judges need to figure out if that’s a reasonable set of rules, but I imagine that would be better than go through all this ambiguity.”

The political and legal questions that Arkansas is wrestling with mirror the broad tensions that school districts throughout the country face: how to promote school choice without fostering racial segregation—admirable, but often incongruous goals.

There’s Plenty of Evidence on the Value of School Integration

I read an exchange on Twitter yesterday between Maggie Severns, an education reporter at Politico, and CJ Libassi, a researcher at the Education Policy Initiative, an organization committed to “applied, policy-relevant research for improved educational outcomes.” They were discussing my recent piece about Obama’s record on school integration. I was struck in particular by this part:

I found it surprising, and worrying, that a prominent education journalist and an education policy researcher would both say that they have looked around and cannot find “any actual evidence” on the value of school integration.

School desegregation conversations are complex and difficult, which is all the more reason we should strive to make our discussions as informed as they can be. I have no idea what Severns’ and Libassi’s attempts to find evidence looked like, but given that perhaps there are other mainstream journalists and researchers who have faced similar issues, I decided it would make sense to quickly post some starting points:

1. The Spivack Archive is an accessible social-science database that explores the impacts of ethnic, racial, and socioeconomic integration. Its stated purpose is to “provide scholars, education rights attorneys, policy makers, and the general public with accessible state-of-the-art knowledge.” The archive has been an on-going project led by sociologist Roslyn Mickelson since 2005. It’s received funding from the American Sociological Association, the National Science Foundation, and the Poverty and Race Research Action Council.

2. The National Coalition on School Diversity, which formed in 2009, has published a series of short policy briefs on the benefits of school integration. The briefs explore impacts on academic achievement, on college attendance, on poverty reduction, on non-minority student impacts, and other areas. NCSD is a coalition of educators, policy advocates, and civil rights leaders.

3. The Civil Rights Project/ Proyecto Derechos Civiles has commissioned hundreds of studies on issues related to desegregation, racial diversity, racial disparities in school discipline and other related areas. CRP is a research and policy think tank that was founded at Harvard in 1996, and has been run out of UCLA’s Graduate School of Education and Information Studies since 2007.

This list is by no means comprehensive, but it’s a decent place to start if you’re looking to familiarize yourself with some of the quality research. I hope more people do, especially those writing and thinking about education.

Obama’s Mixed Record on School Integration

As Congress debates competing revisions of the No Child Left Behind Act over the next several weeks, lawmakers are unlikely to spend much time looking at the growing problem of segregated schools. Despite strong academic and civic benefits associated with integrated schooling, and a unanimous Supreme Court decision which ruled that “separate educational facilities are inherently unequal”—American public schools have resegregated quickly by race and class over the past two-and-a-half decades.

Many advocates had hoped to see the Obama administration take steps to address rising school segregation, but so far its record has not been great. While the Department of Education has paid lip service to the need to promote integrated schools, and has included modest diversity incentives within a handful of federal grants, it refused to use larger education initiatives like Race to the Top to encourage states and districts to prioritize school diversity. In some cases, the department actually pushed policies that made segregation worse.

The Obama administration came to power at an interesting time for the integration movement. With the help of Reagan-appointed judges and justices, court decisions in the 1990s absolved many local districts from their legal obligations to desegregate schools. Between 1988 and 2006, the number of black students attending majority-white schools dropped by 16 percentage points. Between 2000 and 2008, the number of schools where at least 75 percent of students qualified for free or reduced-meals—a proxy for poverty—jumped from 12 percent to 17 percent.

But many districts were also interested in racial and economic diversity, even if they weren’t legally required to promote it. And so various voluntary integration experiments began cropping up around the country. These new efforts seemed promising but quickly faced legal challenge. In a pivotal 2007 decision, Parents Involved in Community Schools v. Seattle School District No. 1, the Supreme Court rejected voluntarily desegregation plans in Seattle and Louisville, on the basis that their particular student assignment strategies relied too explicitly on race. But the Court did clarify that, under certain conditions, districts can use race-conscious measures to promote diversity. Justice Kennedy even endorsed specific strategies to do so, including magnet schools and interdistrict plans.

The years immediately following the Parents Involved decision sparked confusion, largely thanks to the Bush administration. While the majority of Supreme Court justices said districts could consider race in school assignments, the Bush administration posted a federal guidance that suggested only race-neutral means of pursuing integration would be legal.

In 2009, shortly after President Obama took office, a group of educators, policy advocates, and civil rights leaders came together under the banner of the National Coalition on School Diversity (NCSD) to try and push the new administration to take action.

“Our very first goal was to get the Department of Education to take down the guidance from the Bush administration, which told schools they could not promote racial and economic diversity,” said Phil Tegeler, executive director of the Poverty & Race Research Action Council and NCSD coalition member. Their efforts were ultimately successful. By December 2011, the department posted a new guidance, which affirmed the Supreme Court’s decision and listed various ways school districts could pursue voluntary integration.

Other NCSD efforts met less success. One of their primary objectives has been to get the Obama administration to prioritize school integration within their competitive federal grant programs. While Secretary of Education Arne Duncan has repeatedly said that he supports school diversity and wants to reduce racial isolation, his department has not, for the most part, translated such support into its competitive programs.

Despite NCSD’s urging, the department declined to use its largest grant, the $4 billion Race to the Top initiative, to promote racial diversity. Duncan argued that including incentives for voluntary integration would have been too difficult to get through Congress. He also said that when it comes to successful integration efforts, we can’t “force these kinds of things.”

In 2013, Richard Rothstein, a research associate at the Economic Policy Institute,responded strongly to Duncan’s arguments, pointing out that “no education secretary has been as deft as Arne Duncan in creating incentives—both carrots and sticks—to get states to follow his favored policies that are technically voluntary.” Duncan used incentives to get states to adopt Common Core standards, to promote after-school programs and early childhood education, and even within Race to the Top, incentives were used to encourage states to adopt teacher evaluation systems tied to student test scores. But in the case of school integration, Rothstein noted, suddenly Duncan sings a different tune.

“Only in this area, apparently, does Secretary Duncan believe that progress must be entirely voluntary, unforced by carrots and sticks,” Rothstein wrote. There have been plenty of opportunities to incentivize racial integration, such as rewarding states that prohibit all-white suburbs from excluding poor people through zoning ordinances, or withholding No Child Left Behind waivers from states that allow landlords to discriminate against families using federal housing vouchers. “Adoption of such ‘voluntary’ policies could make a contribution to narrowing the academic achievement gap that is so much a focus of Secretary Duncan’s rhetoric,” Rothstein said.

Despite a frustrating first term, desegregation advocates have seen some progress in the last couple years. The Department of Education recently began to include diversity as a funding priority in several of its smaller grant programs like the preschool development grants and its charter school grants; it also announced that magnet-type integration approaches are eligible for the school improvement grants (SIG) program.

While modest, these changes have led to some important new integration experiments. At the end of 2014, New York’s education commissioner, John King, helped launch a socioeconomic integration pilot program to increase student achievement using newly available federal SIG funds. King has since moved to the Department of Education, where he now serves as Arne Duncan’s senior advisor.

Other advocates have capitalized on the Department of Education’s 2011 guidance. David Tipson, executive director of New York Appleseed, says it was an absolute game-changer for his work in New York City. “Getting that correct interpretation, with some real practical guidance for school districts, I can’t even emphasize how important that was,” Tipson said. “There was a very deliberate effort to misconstrue the 2007 [Supreme Court] decision and put fear into many school officials across the country. Everything we’ve been able to do to promote school integration has come in the wake of getting that new federal guidance in place.” New York Appleseed, along with community stakeholders, sought to design a zoning plan that would help keep a school located within a gentrifying Brooklyn neighborhood integrated. Officials resisted at first, but they eventually relented after advocates presented them with the federal guidance. Thus at the beginning of the 2013-2014 school year, Brooklyn’s P.S. 133 became the first school in Bloomberg’s administration to foster a specific mix of students based on socioeconomic status and English proficiency. At the school’s ribbon-cutting ceremony, the city’s school chancellor said he believed their innovative admissions model could be replicated elsewhere.

While advocates of desegregation are happy to see the administration beginning to prioritize diversity within its grant programs, some feel these gestures are too little, too late.

In a letter sent to Secretary Duncan last July, NCSD noted that while the Department of Education has included preferences for diversity within some grant programs, in practice, the department has “consistently underemphasized” these incentives. Many grants still make no mention of diversity at all, and in cases where they do, officials tend to weigh other competitive priorities far more heavily, rendering the modest diversity incentives ineffective. For example, in one grant, applicants could earn an additional five points if their school was diverse, but applicants could earn twice as many bonus points if their school would serve a high-poverty student population

The only federal education initiative to significantly emphasize integration is the Magnet School Assistance Program (MSAP), a program first launched in 1976. However MSAP has limited impact today due to the small amount of federal funding it receives. Even though charters are far more likely than magnets to exacerbate segregation, the department gave MSAP $91.6 million in 2014, compared to the $248.2 million it gave the Charter Schools Program.

Advocates have not given up. Next month in D.C., the NCSD will be hosting a national two-day conference, bringing together scholars, educators, parents, students, and policymakers to continue, “building the movement for diversity, equity, and inclusion.” John King will be speaking on a panel there about the progress they’ve made, and further challenges they face on the federal level. NCSD hopes that King’s new role at the Department of Education will motivate the government to take integration efforts more seriously. The department’s press secretary, Dorie Nolt, told The American Prospect that “we’ve taken meaningful steps, and we want to do more.”

Yet this administration has fewer than 18 months left. And the next secretary of education could quite easily end even the modest progress that NCSD has fought for. “Promoting voluntary school integration is an area where the department has a lot of leeway to act on its own, in terms of trying to encourage state and local governments to prioritize diversity,” said Tegeler. “But that also means the next department has a lot of leeway to not act.”

Unionized Charter Teachers in Chicago Reject Merit Pay

Last week, unionized teachers at three schools operated by Civitas—a subsidiary of the Chicago International Charter School network—negotiated a new contract that no longer has merit pay in it. This means 31 out of 32 unionized Chicago charter schools have now rejected merit pay. And the one unionized charter that still has it—Rudy Lozano Leadership Academy—is currently negotiating a new contract and teachers hope to remove it there as well.

Merit pay, a policy that ties teacher salaries and bonuses to student standardized test scores and evaluations, is one of the most controversial tenets of the education reform movement. The idea has been tossed around for decades, but has never really gained steam. Most teacher salaries are tied to their level of education and the number of years they’ve been teaching.

Michelle Rhee, former chancellor for Washington, D.C., schools, says merit pay is needed to create the kind of culture “where excellence is rewarded.” Proponents believe that this kind of policy would incentivize high-quality teachers to enter the profession. The Obama administration’s $4.3 billion Race to the Top program encouraged states to implement merit pay systems within their schools.

While teacher salaries are notoriously low, many teachers have generally opposed merit pay because they do not think the system in which they’d be evaluated could ever really be objective or fair. They also worry that it could have unintended consequences, like incentivizing cheating or teaching to the test.

Brian Harris, the president of the Chicago Alliance of Charter Teachers and Staff, said that when his school unionized in 2009, they first tried to improve their “really awful” merit pay scheme by negotiating more objective metrics into their evaluation system. Teachers aimed to reform merit pay, not remove it.

Over time, according to Harris, teachers began to feel increasingly frustrated with even their new-and-improved merit pay system. When I spoke to Harris in April as I was reporting my When Charters Go Union piece, he had told me, “the opposition to merit pay at my school has grown insane.” Four months later, it’s now gone.

I asked Harris if anyone in his union wanted to keep merit pay and he said he has no idea. “Nobody has been brave enough to tell me to my face that they like merit pay.” He did note that some who like the idea of paying teachers who work really hard more money, acknowledge that it is really difficult to do so fairly. “Even a lot of people who were evaluating us acknowledged that this stuff was unfair,” Harris said.

About eight months ago, their union released a document with guiding principles for contract negotiations. Beyond killing merit pay, other contract goals include advocating for smaller class sizes, increasing teacher voice, and securing protected time during the workday to grade, plan, and collaborate.

It will be interesting to see if the momentum that unionized charter school teachers have created in Chicago motivates other non-unionized charter teachers who are dissatisfied with merit pay to consider unions of their own. It will also be interesting to see if this creates any pushback from the public—a majority of public school parents say they support the idea of merit pay.

NLRB Rules Teach for America Members Have a Right to Unionize

In another interesting development for the movement to unionize charter schools, the National Labor Relations Board ruled last week that Teach for America corps members should have been allowed to vote in a Detroit charter union election earlier this year.

Detroit 90/90, a charter management organization for the University Prep charter network, said that Teach for America teachers shouldn’t be permitted to vote because they are not professional employees. Instead, they argued, TFA members should be viewed as long-term substitute teachers.

Patrick Sheehan, a Detroit TFA-er told MLive that he and his fellow corps members are really pleased with the NLRB’s decision. “U-Prep hired us to teach just like other teachers. Making the legal argument that we are not professionals means one of two things: Either Detroit 90/90 doesn’t respect the work we do with students or they lied to prevent us from organizing a union.”

Shaun Richman, the AFT’s deputy director of organizing told The Prospect that University Prep’s argument was an insult to all TFA corps members and alumni around the country. “Nobody would have dared to say that TFA corps members are not really teachers even a year ago,” said Richman. “But now that they want a union, suddenly those kinds of insults are apparently on the table.”

While Teach for America does not officially take a stance on unionization efforts, Takirra Winfield, TFA’s head of national communications, praised the NLRB’s decision. “We’re pleased that the National Labor Relations Board acknowledged that our teachers are professional, qualified educators who are deeply invested in their school communities and are able to make individual choices about their union membership,” she said. “As a TFA network, we know there is tremendous strength in the diversity of perspectives among our talented corps members and alumni as they work to help make certain that every child has access to an excellent education.”

There are roughly 11,000 current TFA teachers and more than 37,000 alumni around the country. About 60 percent of Detroit Teach for America corps members work in charter schools. Nate Walker, AFT-Michigan’s K-12 organizer and policy analyst, was a former Detroit TFA-er himself.

It’s likely that we’ll continue to see more union campaigns launched at charter schools, and more Teach for America members among them. Many TFA-ers are progressive and young, and national surveys find that young Americans are among the country’s most ardent union supporters. According to Pew, fully 55 percent of Americans aged 18 to 29 held a favorable view of unions, while just 29 percent held unfavorable ones.

A New Course: Larry Hogan wants to change Maryland’s unique charter school laws and bring in more charters, but will kids suffer?

At the end of 2014, just weeks after Larry Hogan won a surprise victory in the gubernatorial race, the governor-elect announced that he would push to expand Maryland charter schools once in office.

“We shouldn’t be last in the nation in charter schools,” Hogan declared—referring to Maryland’s spot in the state ranking system designed by the National Alliance for Public Charter Schools (NAPCS), an advocacy organization that promotes charter schools around the country. According to NAPCS, Maryland has the nation’s “worst” charter law. The Baltimore Sun editorial board, echoing NAPCS, has said Maryland boasts one of the “weakest” charter laws in the United States.

In late February and early March, legislators in Annapolis listened to testimony related to charter reform bills that Gov. Hogan introduced in the House and Senate. Supported by the Hogan administration, a coalition of charter school operators, and national education-reform advocates, the bills met fervent opposition from teachers, principals, and community members.

“I don’t care what the National Alliance for Public Charter Schools, a lobbying group out of Washington, D.C., has to say about the charter school law in Maryland or where they rank Maryland relative to their own biased standards. Neither should you,” testified Megan Miskowski, a speech language pathologist at Patterson Park Public Charter School. It’s Maryland’s strong law, she argued, that explains why Maryland charters have never wrought the level of fraud and abuse so prevalent in places such as Minnesota and Louisiana—states that receive high marks from NAPCS. “Who are they to define what is best for Maryland children?” Miskowski asked. “We do not answer to them.”

The Maryland Charter School Act passed in 2003 and the first state charter schools opened their doors in 2005. A decade later roughly 18,000 students attend 47 Maryland charters—34 of them concentrated in Baltimore City. A version of the Public Charter School Improvement Act eventually passed, but it was substantially watered down from Hogan’s original proposal, and many believe he’ll push a stronger law again next year. The heart of the debate centers on competing visions for the future of public education, and whether one believes Maryland has the best charter law in the country or the worst.

The publicly funded but independently managed schools known as charters have grown significantly since the first one opened in Minnesota 23 years ago. Today more than 6,700 charters exist in 42 states and Washington, D.C. and their numbers are climbing. Albert Shanker, then-president of the American Federation of Teachers (AFT), first proposed the charter school idea in 1988; the influential union leader imagined a new kind of school that could serve as a laboratory for innovative and experimental education practices. The hope was not only to serve kids within charters who might benefit from alternative educational models, but also to carry newly discovered best practices back into traditional schools for all students to enjoy. In Shanker’s vision, charter teachers would still be unionized district employees, but certain labor regulations would be relaxed to promote greater innovation.

Maryland’s charter culture sets it apart from most other states in several ways. First, under the law all Maryland charter teachers are considered public school employees and represented under their district-wide collective bargaining unit. While this actually most closely resembles what Shanker had imagined, few states today adopt this particular model. According to the Center for Education Reform (CER), just 7 percent of all charter school teachers nationwide are unionized.

Another distinctive characteristic of Maryland charters has been a general commitment to innovate within the district, as opposed to outside of it. In other states, the law may allow for multiple charter authorizers, such as churches, universities, or nonprofits. In Maryland, however, only the local school board can authorize charter schools. “I’d say the strong desire [of Maryland charters] to work within the school district is fairly unique,” says Joceyln Kehl of the Maryland Alliance of Public Charter Schools, a newly formed coalition of charter operators around the state. “Maryland is hugely pro-union and Democratic, so that’s just our context,” she adds.

Additionally, Maryland charters must comply with a greater number of state and local regulations than charter schools in other states. While detractors of Maryland’s law argue that this creates an inflexible environment for the independent schools to operate in, supporters point out that Maryland has not had any of the kinds of problems related to fraud, abuse, and mismanagement that charter schools in states with decreased regulation have had. “It is true that Maryland charter school law provides more oversight than many other states,” testified Deborah Apple, a charter school teacher at the Baltimore-based Wolfe Street Academy. “It is also true, however, that our charter school system is more effective than most.”

A stronger level of oversight, a close relationship with the school district, and unionized charter teachers illustrate the uniqueness of Old Line State charters. The vast majority of schools are considered “mom and pop” charters, meaning parents or former local educators founded them, as opposed to some of the larger national charter management organizations (CMOs) that have developed presences in other cities. According to an Abell Foundation report released this year, many high-performing CMOs have expressed reticence or disinterest in coming to Maryland given the conditions in which they’d have to operate. While the Maryland charter law has facilitated the growth of strong schools with little to no fiscal and academic issues, the question is whether such growth is sufficient, and whether the state’s law should change in order to entice more CMOs to expand into Maryland.

Baltimore’s 34 charter schools educate 13,000 of the district’s 84,000 students. Bobbi Macdonald, co- founder of the City Neighbors Charter School, is one of Charm City’s veteran operators. City Neighbors was one of the first charters to open up in 2005, and since then Macdonald has opened two more schools. Reflecting on the evolving dynamics between Baltimore charter operators and the district, Macdonald describes years of intentional relationship building. “I don’t believe that school systems are made out of steel, they’re made out of people,” she says.

In 2004, after the charter law passed and before the first schools opened, Baltimore’s new charter operators formed a coalition to organize and advocate for their collective interests. This coalition grew increasingly formalized as the years went on. “The work of the coalition became really focused on defending our autonomy and the rights of children in charter schools,” says Macdonald, who served as the coalition’s co-chair for the first six years.

Many charter operators spoke favorably, even nostalgically, of Dr. Andrés Alonso’s six-year tenure as city superintendent, which ended at the end of 2012-2013 academic year. “Dr. Alonso had a clear vision of wanting to provide a portfolio of school options for families, and to create opportunities for innovation and then replicate those practices,” says Allison Shecter, the founder of the Baltimore Montessori Public Charter School, one of the city’s most popular charters. “I think when Dr. Alonso was here we had a really strong relationship and participated in a lot of ways on many different levels,” says Macdonald.

Since Alonso’s departure, the relationship between charter operators and the district has grown more strained. “I’d say it’s a challenging relationship. It’s not a partnership unfortunately,” Shecter says. “We’d like it to be a partnership but in order for it to be a partnership there needs to be consistent and ongoing communication back and forth around policies that may impact charters.” Many operators say they feel the district is neither accountable nor transparent, which fuels growing levels of distrust.

One issue charter operators repeatedly raise is that they believe the district short-changes them when it comes to per-pupil funding. Under state law, the district must provide “commensurate” funding between traditional schools and charters. Currently, the district allocates $7,300 per traditional school student, and $9,400 per charter student—which is supposed to take into account that Maryland charters have to pay for the cost of their facilities, programming, salaries, and other school-level costs, which the district pays for in traditional schools. However, the formula that the district uses to come up with these amounts is unclear, and operators are convinced that what they’re getting is too low. Charter operators believe that they should be getting closer to $14,000 per pupil. Debates around these dollar amounts grow very charged.

Not everyone at charters agrees the district is shirking its funding responsibilities. “Charters still receive more per pupil, even after those extra costs are covered,” says Matthew Hornbeck, the principal at Hampstead Hill Academy, a charter located just south of Patterson Park. “Everyone, with the exception of some of the charter operators, knows that.” Hornbeck, who has served as his school’s principal for 12 years, has been outspoken about what he sees as a district funding formula that unfairly favors charters.

“I was a charter operator and I absolutely knew we were getting more than traditional public schools,” adds Helen Atkinson, the executive director of Teachers’ Democracy Project, a local organization that helps teachers engage in public policy and develop more social justice curricula.

Jon McGill, the director of academic affairs for the Baltimore Curriculum Project, the city’s largest charter operator, describes the relationship between charters and the school district headquarters on North Avenue as “overall harmonious” but says he does wish the district would be more transparent about how about how exactly it spends its slice of per-pupil funding. He thinks charters “lose the PR game” because the public sees them as always asking for more money. One reason the funding issues get so heated, McGill suggests, is because some operators have taken huge personal risks to open charter schools, and feel they need more reassurance that the district truly supports their efforts. “Some people have 30-year mortgages to worry about,” he says.

While for the past decade the story of Baltimore charters has mostly been an intra-district struggle, Gov. Hogan’s rise to power signified a turning point for the Maryland school-choice movement.

The legislation Hogan introduced would have dramatically changed the charter law passed in 2003. His proposals included provisions to exempt charter school employees from the district bargaining unit, as well as from many state and local requirements such as teacher certification. Hogan’s bill would have enabled charter schools to compete against traditional schools for state public construction money, and the bill would have required districts to explicitly define “commensurate funding” to mean that charters should get 98 percent of the per-pupil amount that traditional public school students receive, leaving 2 percent left over for district administrative expenditures.

“It did take us by surprise,” says Kehl. “As a charter sector, we were not expecting legislation this year, and we’re grateful that Governor Hogan finally wanted to cast an eye on the charter sector.” While charter operators around the state met with legislators and held school meetings to discuss why they supported Hogan’s bill, Kehl acknowledges that their advocacy “wasn’t as robust an effort had we been really prepared for it.”

Once news of Hogan’s charter bill went public, Maryland charter teachers began to organize together in new ways. In Baltimore, teachers convened and decided to form the Baltimore Charter School Teacher Coalition. Educators broke up into committees to strategize and implement an organized political response to the bill.

Corey Gaber, a sixth-grade literacy teacher at Southwest Baltimore Charter School who was active in the coalition, says part of the reason they formed their group was because they were dissatisfied with the pace and quality of the Baltimore Teachers Union’s (BTU) response. “We felt like we needed to reach out and inform teachers about what was going on and we didn’t feel like the union was doing it effectively,” he says. Gaber acknowledges that among Baltimore charter teachers there exists a “constant contradiction of feelings”—in some ways they are dissatisfied with the current union leadership, but on the other hand, teachers are proud to be being unionized district employees and deeply value their protections. With fellow charter teacher Kristine Sieloff, Gaber wrote an Op-Alt for City Paper (“The injustice of a two-tiered education system in Baltimore City,” March 31) and Gaber created and helped to circulate a petition that garnered hundreds of signatures from both charter and traditional public school teachers.

“The interests of traditional teachers in charters and public are exactly the same right now,” says McGill, who thinks the proposed bill would have created deep divisions between Baltimore educators.

The BTU helped circulate another petition for charter teachers and charter educational support personnel, roughly 740 people in total, and more than 90 percent of eligible petitioners signed. “I spoke with every teacher I know, teachers were universally against [the legislation],” Gaber says.

In addition to local educators who worried about losing their collective bargaining rights and allowing non-certified teachers to work with kids, other leaders pushed back against what they saw as a deeply inequitable funding structure embedded into Hogan’s legislation.

“Charter advocates rely on the premise that as money flows from a regular school to a charter school, the costs of the regular school go down proportionately. Sounds good; it’s just not true,” wrote David W. Hornbeck in a Baltimore Sun op-ed published in February. Hornbeck “recommended the approval of more than 30 charter schools” while serving as Philadelphia’s superintendent of schools from 1994 to 2000, and he now believes he made a grave mistake. Hornbeck, who also served as superintendent of Maryland schools from 1976 to 1988 (and is the father of Hampstead Hill principal Matt Hornbeck), pointed out that Pennsylvania’s charter law is ranked much higher than Maryland’s and “yet its charter growth is contributing significantly to a funding crisis that includes draconian cuts to teachers, nurses, arts, music and counselors in Philadelphia.”

Bebe Verdery, the director of the Maryland ACLU Education Reform Project, also submitted testimony against the bill, arguing that the proposed funding formula would result in severe cuts to traditional schools. “Simply put, students without any special needs would get funding the state formula intended for others,” she said. Verdery also objected to a provision that would have allowed public capital repair funds to go toward private buildings that housed charter schools, saying, “this would further strain an already insufficient pool of state resources for addressing the state’s $15 billion school repair and construction backlog.”

Hogan’s legislation said “commensurate funding” should mean that charters get 98 percent of what traditional public schools receive because a 2005 State Board of Education ruling determined that districts needed only 2 percent of per-pupil funding to cover central administrative costs. But when the Department of Legislative Services (DLS) surveyed local school systems later on, it found that administrative expenditures make up closer to 10-14 percent of per-pupil spending. Critics argued that if 98 percent were legally guaranteed for charters, but necessary administrative work still had to be done, then money would be taken from traditional public school students, potentially leading to increased class sizes, special educators with enormous case loads, or cuts to after- school programming, gym, and art.

Local charter operators insisted that their goal was not to bankrupt the district, but simply to fight for parity. “We believe strongly that we can achieve this without harming funding for other schools,” testified Ed Rutkowski, the executive director of Patterson Park Public Charter School.

The watered-­down bill that Hogan ultimately signed was a grassroots victory for some, and a major disappointment for others. The Center for Education Reform, which hired several lobbyists to push for the bill’s passage, was so dismayed with the final result that it actually urged the governor to veto it, insisting that this would be a step back for Maryland school choice, not one forward.

The final bill ended up removing mostly all provisions that had generated controversy. It grants greater autonomy to charters that have demonstrated five years of success, and it provides for increased flexibility with student enrollment. The bill also authorizes the Maryland State Department of Education (MSDE) and the DLS to complete a study by the end of October 2016 to determine what a more appropriate figure should be for districts when it comes to commensurate funding.

“The law that passed was more subtle and more evolutionary rather than revolutionary,” said Hampstead Hill’s Hornbeck. “It did not trash a good law, like the governor’s proposal tried to do.”

Given that the governor still had support from MarylandCAN, a pro-charter advocacy organization that helped to craft the original legislation, Hogan went ahead and signed the bill into law. It’s an imperfect bill, but it creates “the pathway” to expand charters and it grants more flexibility to existing ones, said Keiffer J. Mitchell Jr., Hogan’s special adviser on charter schools.

“As the state with the most restrictive charter law in the country, these small steps forward, while welcomed, are not enough,” said Jason Botel, the executive director of MarylandCAN, in a statement. “They must be the start, not the end, of our work to dramatically reform charter school policy in our state.”

Kara Kerwin, the president of CER, believes MarylandCAN is mistaken to think that they can just go back and improve on the new law later. She points out that the new law clarifies that only the local district board—not the Maryland State Board of Education—can authorize new charters, and that online charter schools are now explicitly prohibited from operating within Maryland.

In an interview, Kerwin describes online charters as “one of the biggest innovations right now that’s helping so many students who aren’t brick and mortar types.” However, several studies have found that online charter schools tend to provide a lower-quality education than traditional schools, and a 2011 New York Times investigation found that K12 Inc., one of the nation’s largest online charter school operators, “tries to squeeze profits from public school dollars by raising enrollment, increasing teacher workload and lowering standards.”

Most people interviewed for this story do not believe the new law will lead to an expansion of Maryland charter schools, one of Hogan’s top policy priorities. “The final bill that passed was very limited in scope, it doesn’t have a whole lot of changes,” Macdonald says. “But it’s a step in the right direction.”

So what does this all mean for the future of Maryland charters?

“I have no doubt that this was round one and [the operators] are going to try again as long as Hogan’s governor,” Gaber says. “We’re going to keep fighting. We started this teacher coalition knowing that this is a long-term fight and we need to be organized and ready before the next time comes.”

Kehl thinks that the Maryland Alliance of Public Charter Schools, which just officially emerged as a statewide group in July, will focus on building a more unified policy voice and cultivating a stronger presence in Annapolis. “Our charter sector has matured,” she says. “If you believe that schools shouldn’t be one size all, then you have to create a system that supports that. I don’t see how you can make change if you keep everything the same.”

Whether new legislation will be introduced next year is an open question. Kerwin of CER thinks such an effort would be futile, even if they tried. Todd Reynolds, the political coordinator for Maryland’s American Federation of Teachers, says some legislators might decide it makes sense to wait until after the new MSDE/DLS study is completed.

While the emerging landscape appears fraught with tensions between the district and the charter sector, there still remains a possibility that Maryland charters will chart a different sort of future than that of other states.

Even though Macdonald of the City Neighbors Charter School supported Hogan’s legislation, she acknowledges that some parts made her feel ambivalent. While she feels strongly that Maryland charters need more autonomy and bureaucratic relief, she also wants to preserve collective bargaining rights for charter teachers. “I feel like Maryland is so unique in our stance,” she says. “I haven’t yet seen the bill I would really fight for.”

In a few months, on Oct. 22, the Teachers’ Democracy Project will be hosting a big meeting between teachers, charter operators, politicians, union officials, and school board members to try and figure out a way forward that doesn’t require another heated legislative fight. Atkinson believes the current law is good, but that Baltimore teachers—charter and non-charter alike—should be organizing for more money for all schools. “We’re going to try to hold an open conversation about what people’s concerns are,” said Atkinson. “The operators are reasonable, they’re not right-wing, they’re not trying to get charters to take over the world. Their main frustrations are with the union contract and some of the ways the district controls things.”

McGill thinks that a more collaborative push for charter reform from the district, teachers, and charter operators “would be the ideal” solution but worries things are growing too polarized for that to materialize. Gaber, however, says that the Baltimore Charter School Teacher Coalition has also discussed how they want to stand for something, and not just against reform. “I think it would be a good idea for us to be more proactive,” adds Reynolds of the AFT. “We should get back to what charters were intended to in terms of offering innovation that can then be brought into traditional schools.”

The question of whether some of the larger CMOs would be interested in setting up schools in Maryland remains uncertain. Kehl says it’s important to help facilitate more attractive operating conditions because “there’s a certain point where you tap out your local leadership” and if you “can’t attract national talent” into Maryland, then you’ve just closed the door on quality options for kids.

Others see luring CMOs as a less urgent priority, especially given how the state increasingly underfunds public education. In his latest budget, Hogan increased state education funding by 0.4 percent, but cut Baltimore City’s funding by 3.3 percent. Attracting those CMOs—which would likely be into Baltimore—might mean redirecting funds toward charter facility expenses or pushing harder to restrict collective bargaining. Maryland might also experience some of the financial strain that rapid charter growth in other states has placed on traditional schools.

Testifying last spring, CEO of Baltimore City Public Schools Dr. Gregory E. Thorton said Hogan’s bill would work “to the benefit of large out-of-state charter organizations—to the detriment of Maryland’s most vulnerable student populations.”

While the Baltimore City School District might need to work harder to collaborate with its local charter sector, and the teacher unions may need to re-examine some provisions within their contracts, it’s not yet clear that Maryland’s unique charter culture is headed out the door.

State law currently allows charters to negotiate waivers and exemptions from certain aspects of the district-wide collective bargaining unit. That’s how Baltimore’s KIPP charter school was able to extend its school week; KIPP had to agree to pay its staff more money for the increased number of working hours. Theoretically charter operators could sit down with union leaders to discuss some of their most pressing concerns around staffing, innovation, and autonomy. “It’s not meant to be a one-size-fits-all situation,” says Reynolds. “You can sit down with the union and negotiate a Memorandum of Understanding. We have done that, and I think that’ll continue.”

“I think it would be amazing to sit down with the union and really roll up our sleeves,” says Macdonald. “I do think it’s really important for teachers to be unionized, to collectively bargain, and to get paid well, but I also think if we want to innovate and serve the children of Baltimore, we really have to allow [for] some more flexibility.”

Will Students Soon Be Tested for ‘Grit’?

The National Assessment of Education Progress (NAEP)—nicknamed “the Nation’s Report Card”—is the largest nationally representative assessment that tests what American students know and can do in different subjects.

Curiously, it was recently announced that beginning in 2017, NAEP plans to start measuring so-called “non-cognitive skills” like motivation and grit in the background surveys they issue to all test-takers. Additionally, according to Education Week, questions about “self-efficacy and personal achievement goals may be included on questionnaires for specific subjects to create content-area measures.”

Though schools won’t be judged based on these NAEP measures, the article says, “other such tests for accountability purposes may be on the horizon.” A coalition of seven districts in California are reportedly developing an accountability system that will evaluate schools in part by including measures of “growth mindset, self efficacy and self-management, and social awareness.” These are supposed to be in place next year.

The odd thing about this NAEP announcement is that very recently psychologists Angela Duckworth and David Scott Yeager published a paper in the journal Educational Researcher arguing that while emerging findings on character skills are promising, existing research is not ready to be incorporated into accountability assessments. Angela Duckworth told NPR that she feels “enthusiasm” for these measures “is getting ahead of the science” and that wanting to use these skills for evaluation would be gravely premature.

In April I published a long piece on the rise of grit fervor in education reform, which looked at the ways in which current tools to measure grit and other character traits are flawed. There are significant limitations to self-reported assessments, and Duckworth and Yeager’s subsequent journal paper echoed these concerns. Researchers haven’t given up on developing improved measures, and they are currently exploring future possibilities like computer simulations.

The intellectual humility Duckworth and Yeager demonstrated in their paper (and this video) is quite impressive, and should not be understated. Why school districts and NAEP are still intent on moving forward quickly with measuring these skills then deserves some further clarification.

Sorry, Walmart: Charter Schools Won’t Fix Poverty

Last week, the American Federation of Teachers (AFT) and In the Public Interest released a highly critical report on the Walton Family Foundation’s K-12 education philanthropy, which ended with a call for increased transparency and accountability in the charter sector. The gist of the report is that the Walton Family Foundation—which has kick-started about one in four charters around the country—“relentlessly presses for rapid growth of privatized education options” and has opposed serious efforts to regulate and monitor fraud and abuse. While the foundation supports rapidly scaling up charter networks that have produced promising results, the AFT and In the Public Interest cite a 2013 Moody’s Investment Services report which found that dramatically expanding charter schools in poor urban areas weakens the ability of traditional schools to serve their students, forcing them to lay off teachers, increase class sizes, and cut programs to make ends meet.

A month earlier, Philamplify, an initiative of the National Committee for Responsive Philanthropy (NCRP), published its own report on the Walton Family Foundation’s impact, and found that although they have achieved meaningful results through their environmental philanthropy, “an overreliance on specific market-based vehicles” hinders their ability to create “sustainable and equitable” improvements in education. Philamplify also criticized the Walton Family Foundation for “insulating itself among like-minded peers rather than connecting with the broader field.”

While the Walton Family Foundation did not return my request for comment, Education Week reported that their spokesperson, Daphne Moore, defended their commitment to high-quality schools. Education Week also cites Greg Richmond, the president of the National Association of Charter School Authorizers (NACSA)—an organization that receives funding from the Walton Family Foundation—who argued that the foundation has long demonstrated a commitment to accountability and transparency.

This discussion is sure to continue over the coming months, but what was particularly striking was something in the Walton Family Foundation’s response to the Philamplify report—a statement that has been reiterated by the foundation many times over the past several years. Marc Sternberg, the foundation’s K-12 program director, said, “Education is the set of work we can support that will most directly end the cycle of poverty and change the trajectory of young people’s lives.”

The notion that education is needed to break the cycle of poverty is a popular mantra of the education reform movement. The problem is, it is simply not true at all. The most direct way to break the cycle of poverty is actually to give poor people more money, something that high-quality educations, even college degrees, do not in any way guarantee. So when it comes to the question of redistribution—an integral component to any comprehensive anti-poverty program—the political work of the Walton family deserves far greater scrutiny.

Waltons, Walmart, and Politics

The Walton family heirs own a majority of public shares in Walmart, the U.S.’s largest private employer, which easily makes them some of the richest people on earth. Today, the Walton family has more wealth than 49 million American families combined. The six Walton heirs together have a net worth of at least $148.8 billion.

The Walton family engages in quite a bit of political work outside of its environmental and education philanthropy—much of it to advance conservative legislative goals. In the 2014 electoral cycle, Walmart spent $2.4 million through its PAC and individual donations, and $12.5 million through lobbying. According to the Center for Responsive Politics, Walmart was far and away the biggest big-box retail spender in the election cycle, and has been ranked among the top 100 political donors since 1989. Demos looked at the Walton family’s political contributions between 2000 and 2014 and found that their $7.3 million in campaign contributions heavily favored Republican candidates over Democrats.

Outside of political campaigns, Walmart employs an array of Washington, D.C., lobbyists to advocate on issues like labor, taxes, and trade. Up until May 2012, Walmart was a longtime member of the right-wing American Legislative Exchange Council (ALEC), which works to promote an ideologically conservative agenda around the country. Moreover Walmart has given millions to the Republican State Leadership Committee, the Republican Governors Association, and other organizations that push right-wing policies.

Their animus towards union and labor is no secret, and Walmart has fought strengthening labor law in Washington, D.C., as well as supporting efforts to expand right-to-work laws in state legislatures. In addition, as veteran labor reporter Steven Greenhouse reported for The Atlantic this month, Walmart “maintains a steady drumbeat of anti-union information at its more than 4,000 U.S. stores”—much of which is patently false.

Beyond their efforts to elect conservative candidates and promote right-wing causes, the Waltons also fight against efforts to promote a greater redistribution of wealth through taxation. According to Treasury Department estimates, closing just two estate tax loopholes that the Waltons use would raise more than $2 billion annually over the next decade—but they have long lobbied against any effort to do so. Americans for Tax Fairness, a coalition of 400 national and state organizations that seeks to promote progressive tax reform, found that Walmart and the Walton family benefit from an estimated $7.8 billion in annual tax breaks, loopholes, and subsidies—much of which stems from the fact that so many of Walmart employees earn meager wages and are forced to rely on public assistance.

After years of worker organizing and public pressure, Walmart recently announced that it would raise its hourly wages to $9 an hour by April and $10 an hour by February 2016. While encouraging, such measures alone are unlikely to mitigate the economic hardship most Americans face—especially when, at this point, many cities are pushing for a minimum wage of $15 an hour.

Economic Inequality and Public Education

The evidence that shows impoverished kids are disadvantaged in school is well-documented—and yet many education reformers insist that despite this, we can still provide every child with a high-quality education so that everyone succeeds. We shouldn’t use poverty as “an excuse,” they say.

The idea that we can redesign education to be excellent and equitable without reducing poverty and economic inequality certainly sounds politically pleasant, but we know it’s just not true. That’s why the education agenda of the Walton Family Foundation has so many internal contradictions. The Waltons say they want to create more high-quality schools to help kids in poverty, but they back candidates who support eroding the already crumbling social safety net and fight against paying their fair share of taxes. And while the Waltons continue to advocate aggressively against unions, the Economic Policy Institute has found that the decline in unionization has mirrored the rise in inequality “to a remarkable extent.”

Not only does poverty hurt one’s chance for success in school, but growing levels of economic inequality also further exacerbate these issues—problems that the Walton heirs do not seem interested in addressing. Stanford sociologist Sean Reardon found that the rich-poor gap in test scores is about 40 percent larger now than it was 30 years ago—though the academic performance of poor students has not declined during this time. He also found that before 1980, affluent students had little advantage over middle-class students when it came to academic performance, but “the rich now outperform the middle class by as much as the middle class outperform the poor.” In other words, growing economic inequality has contributed to disparities in academic achievement across the board, even for those not living in poverty. Other researchers have found that the rich now have much greater access to extracurricular opportunities than the poor. In districts across the country, enrichment programs like art, music, journalism, and athletics are being cut—creating even greater divides between the haves and the have-nots in education.

If we want to reduce poverty and economic inequality—things we know hurt student achievement and life outcomes—then we have to address how the education aims of the Walton Family Foundation are incongruous with their political agenda elsewhere. Closing the achievement gap, as Demos analyst Matt Bruenig points out, will not even reduce poverty; it would merely change the distribution of it. In the education-reform world, unfortunately, grantees are unlikely to criticize foundations because they fear they will be blacklisted or de-funded. This makes sense, as there are incredible power imbalances in the philanthropic sector and money is scarce.

The Walton Family Foundation talks a lot about creating high-quality schools. If Walmart, with its billions of dollars in profits, created high-quality jobs with living wages and benefits, children would be far less likely to grow up in poverty and would perform far better in school. Relatedly, if the Waltons backed candidates who supported a more equitable distribution of wealth and stronger social-welfare policies, then children would be far less likely to grow up in poverty, and perform far better in school. It’s certainly true that every child deserves a high-quality education. How to get there, however, is not rocket science.

When Charters Go Union

The April sun had not yet risen in Los Angeles when teachers from the city’s largest charter network—the Alliance College-Ready Public Schools—gathered outside for a press conference to discuss their new union drive. Joined by local labor leaders, politicians, student alumni, and parents, the importance of the educators’ effort was not lost on the crowd. If teachers were to prevail in winning collective bargaining rights at Alliance’s 26 schools, the audience recognized, then L.A.’s education reform landscape would fundamentally change. For years, after all, many of the most powerful charter backers had proclaimed that the key to helping students succeed was union-free schools.

One month earlier, nearly 70 Alliance teachers and counselors had sent a letter to the administration announcing their intent to join United Teachers of Los Angeles (UTLA), the local teachers union that represents the 35,000 educators who work in L.A.’s public schools. The letter asked Alliance for a “fair and neutral process”—one that would allow teachers to organize without fear of retaliation. The administration offered no such reassurance. Indeed, April’s press conference was called to highlight a newly discovered internal memo circulating among Alliance administrators that offered tips on how to best discourage staff from forming a union. It also made clear that Alliance would oppose any union, not just UTLA. “To continue providing what is best for our schools and our students, the goal is no unionization, not which union,” the memo said.

The labor struggle happening in Los Angeles mirrors a growing number of efforts taking place at charter schools around the country, where most teachers work with no job security on year-to-year contracts. For teachers, unions, and charter school advocates, the moment is fraught with challenges. Traditional unions are grappling with how they can both organize charter teachers and still work politically to curb charter expansion. Charter school backers and funders are trying to figure out how to hold an anti-union line, while continuing to market charters as vehicles for social justice.

Though 68 percent of K-12 public school teachers are unionized, just 7 percent of charter school teachers are, according to a 2012 study from the Center for Education Reform. (And of those, half are unionized only because state law stipulates that they follow their district’s collective bargaining agreement.) However, the momentum both to open new charter schools and to organize charter staff is growing fast.

IRONICALLY, THE FIRST MAJOR PROPOSAL to establish charter schools came from the nation’s most famous teacher union leader. At the National Press Club in 1988, Albert Shanker, the president of the American Federation of Teachers (AFT), gave a speech outlining a “new type of school.” Shanker envisioned publicly funded but independently managed schools, which would be given the space to try out new educational approaches and would continue to receive public dollars so long as their approaches proved to be effective. These schools would act as educational laboratories, testing grounds of new and better practices that could then be adopted by traditional public schools. A few months after his speech, Shanker dubbed his idea “charter schools,” in a reference to explorers who received charters to seek new land and resources. Later that year, the 3,000 delegates at the national AFT convention endorsed Shanker’s charter idea.

At its conception, then, unions were integral to the charter movement. The thinking was that without job security and elevated teacher voice, which unions help ensure, how else would charter teachers feel comfortable enough to take educational risks in their classrooms? In Shanker’s original vision, as Richard D. Kahlenberg and Halley Potter trace in their book A Smarter Charter, not only were charter teachers to be unionized, but union representatives were to sit on charter authorizing boards—the entities tasked with overseeing charter accountability—and all charter school proposals were to include “a plan for faculty decision-making.” In return, certain union regulations would be relaxed in order to facilitate greater experimentation.

The charter movement has grown from a single Minnesota school, which opened in 1992, to more than 6,700 schools spread across 42 states and the District of Columbia. Today, charters educate more than 2.5 million children—more than 5 percent of all public school students. According to the National Alliance for Public Charter Schools (NAPCS), charter enrollment has increased by 70 percent over the past five years. Public support is growing, too: A 2014 PDK/Gallup survey revealed that 70 percent of Americans support charter schools, up from 42 percent in 2000.

Somewhere along the way, however, charter proponents—conservative and liberal alike—decided that having no unions was an important ingredient for charter school success. By making it easier for principals to hire and fire staff, the proponents argued, schools could better ensure that only high-quality teachers would be working in the classrooms. The blame for the widening achievement gap between black and white students, the proponents believed, rested with underperforming teachers and the unions that defended them. Over time, advocates came to see charters not as institutions designed for collaboration with public schools, but as institutions that could compete against them, perhaps even replacing public schools entirely.

As the charter movement developed a more adversarial bent—one that no longer spoke of productive partnerships with public schools, and one that championed union-free workplaces—traditional teachers unions grew understandably defensive. The AFT and the National Education Association (NEA), the nation’s two largest teachers unions, moved to openly oppose charter schools. Only in the past few years has their stance toward charters begun to soften. Beginning in 2007 and 2008, the AFT set up a national charter-organizing division, and today has organizers in seven cities: L.A., Detroit, Cleveland, Chicago, New Orleans, New York City, and Philadelphia. Secky Fascione, NEA’s director of organizing, says that as more charter teachers began approaching her union, the NEA started to see them as educators who should be treated no differently from anyone else. Both unions also recognized that such new national initiatives as the Common Core standards and President Obama’s Race for the Top meant that teachers at charter and traditional public schools faced similar challenges that the unions could help them address.

But organizing charter school teachers while opposing the establishment of more charter schools is no simple balancing act. “How could I support a union that for the last ten years spent a good portion of their time attacking our right to exist?” asks Craig Winchell, an Alliance high school teacher who turned out in opposition to April’s press conference. “They’ve spent the last ten years both supporting anti-charter school board members and fighting in Sacramento against what we do.” Especially when opening a new charter is paired with closing down a traditional school, unions are typically found rallying in protest. Critics argue that unions’ newfound interest in charter teachers, then, is just a ploy to collect more membership dues.

Having abandoned their outright opposition to charters, many of the AFT and NEA’s recent efforts have been focused on shutting down low-performing charter schools, especially within rapidly expanding for-profit chains, and pushing for a set of national charter accountability standards. While the thought of national guidelines for charter school makes many charter advocates squirm, the public overwhelmingly supports the idea. According to a survey conducted this year by In The Public Interest and the Center for Popular Democracy, 89 percent of Americans favor requiring charter management organizations to hold open board meetings with the public, as well as requiring all teachers who work in charter schools to meet the same level of training and qualifications as those in traditional public schools. Eighty-six percent favor requiring greater transparency over charters’ annual taxpayer-funded contracts and budgets, and 88 percent favor requiring state officials to conduct regular audits of charter schools’ finances.

In 2014, the Annenberg Institute for School Reform at Brown University released a report that documented a host of charter school problems, ranging from uneven academic performance to funding schemes that destabilized neighboring schools. The report laid out national policy recommendations designed to promote increased accountability, transparency, and equity.

The AFT and NEA came out strongly in support of the Annenberg standards, and have been working to promote them to state legislatures and school boards around the country. Leaders in the charter world, however, were less than pleased. The National Association of Charter School Authorizers (NACSA), an organization that seeks to influence the policies and practices of state authorizers, called the standards “incomplete, judgmental, and not based on research or data.” Michael Brickman, then the national policy director at the Thomas B. Fordham Institute, a conservative education policy think tank, said the Annenberg standards would stifle charters’ innovation by “bludgeoning them with regulation.” He accused the authors of “standing in the way of progress” with their “overzealous statutory recommendations.” (The president and CEO of NAPCS, Nina Rees, told me she actually likes the Annenberg standards, but doesn’t know if they should be adopted across the board.)

IN 2007, BRIAN HARRIS started working as a special education teacher at the Chicago International Charter School’s Northtown Academy. “I’d just got out of grad school and was happy to have a job,” Harris says. “It didn’t bother me that it was non-union because it wasn’t something I paid attention to.” In May of 2008, the company’s CEO announced that in the following school years, teachers would have to teach a sixth class in lieu of supervising an academic lab (which is similar to study hall). Teachers were surprised and upset at what amounted to significant change in working conditions. Those who didn’t like the new arrangement, the administration told them, could find some place else to work.

It was an eye-opening moment for Harris, and he realized that this is what it meant to have a workplace without an organized staff. “We didn’t know [this CEO], we didn’t have a lot of connections with management, and people were unsure what the line of authority was,” Harris says. So with the help of the Chicago Alliance of Charter Teachers and Staff (ACTS), a union connected to the AFT and its Illinois affiliate, Harris and his colleagues launched a 13-month organizing drive. Yet even when presented with union affiliation cards from 75 percent of the faculty, administrators refused to recognize their union; they insisted that the teachers would have to petition the National Labor Relations Board (NLRB) for an election. The teachers did just that, won the election, and Northtown became the first unionized charter school in Chicago.

Today, Harris serves as president for Chicago ACTS, which has grown to represent 32 charter schools and nearly 1,000 teachers. Chicago ACTS’s relationship with the Chicago Teachers Union (CTU), an AFT local known for its militant opposition to school privatization and charter school expansion, has also evolved substantially over the years.

CTU was initially ambivalent, even suspicious, of these new unionized charter teachers. But Chris Baehrend, an English teacher at Chicago’s Latino Youth High School and vice president of Chicago ACTS, says this wariness was not reciprocated—indeed, ACTS was inspired by CTU and looked to it as a model. In the spring of 2012, as CTU was gearing up for its successful, eight-day strike against Chicago’s school district, ACTS teachers began to discuss how they could best offer CTU support. They decided to put forth a strongly worded resolution at the AFT’s national convention that summer. In it, the charter teachers called for a moratorium on new charter schools and an end to school closings and turnarounds “until their system-wide impact on educational outcomes can be properly assessed.” Baehrend and Harris worked with CTU leaders to finalize the resolution’s language, which was approved, though not adopted as official AFT policy.

The resolution was the first joint action that Chicago ACTS took with CTU. Since then, the two unions have convened for joint delegate trainings, workshops, and even parties. “We’re making conscious efforts to make connections and to encourage charter and traditional public school teachers to be joined in solidarity,” says Jesse Sharkey, the vice president of CTU. Sharkey himself turned out to a press conference in February to publicly support two Chicago charters in the midst of organizing.

ON APRIL 30, EDUCATORS AT North Philadelphia’s Olney Charter High School voted to form a union. The vote came after a long three-year battle with their employer, ASPIRA. With a final tally of 104–38 in favor of unionization, Olney became one of the largest unionized charter schools on the East Coast.

When the Olney campaign first went public, as Jake Blumgart reported for The American Prospect back in 2013, teachers went to deliver their union petition, signed by 65 percent of the staff. “[The principal] not only refused to accept it, but chased them down the hallway to give it back,” Blumgart wrote. That was just the start of a full-bore, anti-union campaign: Administrators held closed-door, one-on-one meetings with teachers and staff, threatened teachers with layoffs and benefit cuts, put anti-union literature in teachers’ mailboxes, required teachers to attend mandatory meetings with anti-union consultants, and announced that teachers could be fired or disciplined for remarks they made about ASPIRA on social media.

When I asked Sarah Apt, an ESL teacher at Olney, if she ever tried to talk to management about workplace issues before going the union route, she laughed. “We’ve had a million committees and conversations,” Apt says. “You can have a conversation with them now! But without your coworkers standing behind you, the [outcome of] the conversation depends entirely on the whims of the administration.”

Apt says she and her coworkers want to build a union that will agitate for themselves and their students, in collaboration with parents and the community. “Chicago [where striking teachers won high levels of community and parental support] has set a new standard for what can be done with a teachers union in the United States,” she says. Parents have been standing behind the Olney organizing effort, from showing up to support teachers at school board meetings to making calls to the administration on their behalf. More than 40 local businesses also signed a petition backing the teachers’ campaign.

Though regional characteristics and local politics shape each charter school’s distinct organizing drive, the general hopes, challenges, and frustrations expressed by charter teachers I spoke with were strikingly similar.

Greg Swanson, an English teacher at Benjamin Franklin High School, the top-performing charter school in Louisiana, echoes Apt’s frustrations about the power dynamics that can inhibit teachers from effecting change in a non-unionized school. (New Orleans has the highest charter density in the country, claiming roughly 90 percent of the city’s public school students.) Before Ben Franklin High’s teachers decided to unionize, Swanson says, they tried different ways to increase teacher voice, such as forming a committee to advocate for teacher and student issues, including better teacher course loads, increased curriculum coordination, and more academic supports for incoming students. “When we brought [our ideas] to the attention of the administration, we were just told that they can deal with some things and not others,” Swanson recalls. “Without the pressure of the union, [our voices are] not heard in the same way.”

In March, after 85 percent of his Ben Franklin colleagues backed a petition in support of unionization, Swanson and his coworkers signed the first collective bargaining agreement for New Orleans teachers since Hurricane Katrina. Teachers not only won greater pay-scale transparency in their contract but also the right to have department chairs elected by their colleagues rather than appointed by their CEO. They won increased time within the school day to prepare lesson plans, greater job security, and a fairer teacher evaluation system.

Ben Franklin has long been regarded as an educational leader in Louisiana, and Swanson’s team understood that their organizing had consequence for the broader political landscape. “We were looking to improve things in our school, but we were also very much aware of the larger implications of this for New Orleans, which is the testing ground for going full-charter,” said Swanson. With this in mind, they worked to develop a contract that they hope can become a model for charter teachers across the city. Teachers at another local charter, Morris Jeff Community School, followed their lead, and are currently negotiating their own contract.

Many New Orleans charter advocates are wary of the turn toward unionization, but some leaders are urging the community to stay calm. Andre Perry, an education policy expert, wrote in The Hechinger Report that New Orleans reformers should be open to unions given the Crescent City’s high rate of teacher turnover. Ten years after Katrina, he wrote, “we’re not going to fire our way to educational success.

EVERY YEAR, THE NATIONAL Alliance of Public Charter Schools publishes a rating system that evaluates each state’s charter law. While charters with collective bargaining agreements are still considered welcome within the charter school family, state laws receive a higher NAPCS score when they allow administrators to hire and fire teachers free from the constraints of a collective bargaining agreement. Nina Rees, the NAPCS president, says her organization places a premium on this because charters should have the freedom not only to hire and fire, but also to expand the school day and workload “without having to constantly negotiate with a centralized bureaucracy.”

Terry Moe, a Stanford political scientist and author of Special Interest: Teachers Unions and America’s Public Schools, thinks that while “teacher voice” is a necessary component to any functioning organization, teachers unions use their power in ways that are not in the best interests of students. Moe and Rees both take the position that in the modern world, unions are not necessary in charter schools, either because there are already sufficient employee protections in place in our legal system, or just because the incentives within the charter world are such that there’s not really all that much to worry about.

“I’m in a nonprofit space,” Rees says. “Why is it that teachers need to have the right [to be in a union]? Why is it that teachers need these protections immediately when they enter the organization?” If one wants some of the protections and benefits that unions offer, she points out, there are other resources available to teachers. The Association of American Educators (AAE), for instance, is a non-unionized professional educators’ organization that offers a “modern approach to teacher representation and educational advocacy.” Membership in AAE can bring you things like liability insurance, supplementary insurance, legal protection, and employment rights coverage. It cannot, however, bring you leverage with your employer.

In A Smarter Charter, Potter and Kahlenberg recommend giving teachers an opportunity to vote on whether or not to form a union when a charter school first opens, rather than having non-union environments be the default option. Where a school has no union, they suggest reserving seats for teachers on charter school boards. But Rees is no fan of these ideas either. “If you start off with the premise that management is against the employee before you even start the enterprise,” she says, “I think it sets the wrong tone.”

The generally small size of charters, Moe adds, also obviates the need for unions. “In small schools, where everyone knows one another and they can talk about their issues …  you’re really not likely to get the same dissatisfaction that would drive people to unionize in the great number of charter schools,” he says.

Leading charter advocates echo Moe and Rees’s sentiments. Chester Finn, a conservative policy analyst, declared, “The single most important form of freedom for charter schools is to hire and fire employees as they like and pay them as they see fit.” Geoffrey Canada, a charter founder hailed as a pioneer by Obama, said that union contracts, “kill innovation; it stops anything from changing.”

Greg Richmond, the president and CEO of NACSA, doesn’t buy the argument that unions are structurally incompatible with charters. “There are people who politically don’t want unions or don’t want charters to be unionized, but [allowing workers to choose] is the law of the land.” The key question, he argues, is whether unionization ends up helping or hurting student achievement—a question that will be resolved empirically. “If teachers want to organize and negotiate for certain things, go ahead,” he says, because in the end, the charter school has to work for students or else its charter will be revoked.

So are unions compatible with fulfilling the promise of charter schools?

I sat down with Juan Salgado, the president and CEO of Instituto Del Progreso Latino, a nonprofit educational organization in Pilsen, a predominantly Latino neighborhood in Chicago, to learn what it’s been like for him to oversee two charters that have unionized with AFT. Salgado believes that unions have been tremendous assets for his schools, particularly around some of the more fraught questions of wages and benefits. Can such issues be resolved “without a union?” he asks. “Yeah. But can we move forward to actually run a school? Probably not.” The mutual buy-in at the end of the negotiating process, Salgado said, created a better spirit at his schools.

Though Salgado was explicit that he disapproved of the way the union conducted its first organizing campaign—the organizers caricatured him as an evil boss, he says, solely to advance their strategy—he still feels the resulting unions, full of organized, passionate people, are no hindrance to excellence. “Unions ask a lot of questions! And that’s OK,” he says. “Critical questioning causes reflection and makes sure you have very good answers. And they demand transparency, and transparency is important. It’s a value that we should all have.”

To date, the best existing research suggests that charter unionization has very little impact on student achievement. Labor economist Aaron Sojourner and education policy researcher Cassandra Hart looked at California charters several years before unionization and then several years after; they found no significant difference in student performance over time, though there was a temporary dip during the initial unionization year, which tends to be a more disruptive period.

Moreover, as Potter and Kahlenberg document in A Smarter Charter, other research on unions and traditional public school performance suggests that unionization either has small positive effects or no measurable effects at all on the achievement of most students. “The research does not paint a picture of unions as an enemy to student achievement,” Kahlenberg and Potter conclude.

That said, there are other ways to think about the way a union might impact a school. Higher teacher salaries, more transparent pay scales, and greater control over working conditions may help attract more qualified candidates to teach. Research does show that increased teacher voice helps decrease teacher turnover, and it also shows that high teacher turnover costs schools millions of dollars, disrupts student learning, and weakens institutional capacity. Many objectives that teachers hope to achieve through unionization are grounded in a desire for greater stability. “We want to stick around, we want to see our freshman graduate, we want to see their siblings and cousins come, we want to make this our home,” says Apt, whose Olney Charter High School has had high teacher turnover from year to year.

IN RECENT YEARS, as growing numbers of charter school teachers have sought to unionize, both the AFT and the NEA have stepped up their efforts to organize them. Since 2009, the AFT has been flying teacher activists from across the country to meet one another, share stories, and strategize national campaigns. The most recent gathering—they usually last three days—took place in Washington, D.C., in April, and Swanson, Apt, and Baehrend were among the 40 teachers in attendance. “The fights are very similar, so what we see one employer do in Detroit, we wind up seeing in other parts of the country too,” says Shaun Richman, AFT’s deputy director of organizing. “Teachers get the opportunity to support each other, and to learn how to deal with circumstances that may arise at their schools later.”

Also in April, for the first time ever, the California Teachers Association (CTA), an NEA state affiliate, convened 65 charter educators from across the state. One California teacher in attendance was Jen Shilen, who teaches U.S. history, economics, and government at California Virtual Academies (CAVA), a network of 11 virtual charter schools for grades K–12. Shilen and others have been fighting for a CAVA union since December 2013. When their workload began to change rapidly and inexplicably, and their many attempts to raise concerns with management went nowhere, Shilen said, they reached out to CTA. CAVA declined to comment.

“Going to CTA’s conference was the first time I’ve gotten to meet other charter educators organizing and it was a major morale boost,” says Shilen, who rarely even sees her own coworkers, since virtual charter teachers work from home.

Teachers organizing at L.A.’s Alliance schools were also there, as were union members from Green Dot, another rapidly expanding charter chain in Los Angeles. Green Dot schools occupy a unique place in the charter world, since their original founder was interested in establishing a unionized workplace from the outset. In 2006, Green Dot management approached the United Teachers of Los Angeles about their teachers joining their union, but UTLA, then fully opposed to charter schools, rejected the offer. As a result, Green Dot educators unionized with CTA, and their union, the Asociación de Maestros Unidos (AMU), had a relatively unfriendly relationship with UTLA for the next several years.

This too is changing. Alex Caputo-Pearl, the UTLA president elected in April 2014, said that his union is now actively pursuing better relations with AMU. AMU in turn, has come out in strong public support not only for CAVA’s organizing drive (which would be with CTA) but also for Alliance’s. Salina Joiner, AMU’s president, says that her organization’s leadership is all “in support and we’ll do whatever we need to do,” adding that she would never work at a non-union charter school.

Real tensions remain surrounding AFT and NEA’s desire to both organize charter teachers and to politically rein in charter schools. Not all charter teachers who’d be interested in a union would support the Chicago ACTS resolution calling for a moratorium on new charter schools. And not all would agree with teachers like Shilen, who lobbied this year at the State Capitol in Sacramento on behalf of California’s “Annenberg Package”—four bills to promote greater charter transparency and accountability.

Joiner feels that union political activity that attempts to limit charter schools’ funding or expansion is “disrespectful to our educators that teach at that school” and “an injustice to parents that want school choice.” Joiner attended the CTA’s gathering of California charter teachers in April, and said that at least the union is now starting to ask them for their input on charter legislation. To CTA’s credit, she thinks the conversation is “moving in a positive direction from what it was before,” but that charter union members “still have a lot to do around the NEA and AFT.”

As more charter schools continue to unionize, CTU Vice President Sharkey expects some charter enthusiasts will walk away. “At some point, charter school teachers will work with the same conditions and pay as all the other schools, and at that point it’s not clear that charters will be as exciting to the entrepreneurs and businessmen promoting them now,” he says.

Unionized charters are not a panacea. The UFT Charter School, which opened in Brooklyn in 2005, was a widely publicized K-12 charter experiment to be run by the New York City teachers union. The results of its elementary and middle schools were mostly abysmal, and they closed down in 2015. (The high school performed better and stayed open.) The Wall Street Journal editorial board triumphantly declared that this episode shows the failure of “union dominance” over American public education. However, they conspicuously made no mention of UFT’s other charter school, University Prep, which has been ranked among NYC’s best.

The Wall Street Journal would never write about University Prep because it “disrupts their narrative” about unions, says Randi Weingarten, the president of AFT. “Look, there is not one silver bullet but what unionization does is it gives teachers a choice and a voice.”

Asharg Molla has been working at the Alliance Gertz-Ressler High School ever since she started as a Los Angeles Teach For America corps member in 2009. She likes working for a charter organization, and believes in its mission of creating a small collaborative community where teachers, board members, and parents can all work together. “But that’s just not what it’s been,” she says sadly. While she speaks highly of her school, colleagues, and principals, she joined in with the Alliance cohort organizing for a union because, she says, she recognizes there are limits to what even a good principal can do within a big, fast-growing organization. She knows too many Alliance teachers who are afraid to speak up, lest they rock the boat and lose their job.

The campaign in Los Angeles is gaining steam. Since Molla and her colleagues went public in March, the number of teachers who have pledged support has more than doubled—146 teachers (out of the roughly 600 who work at Alliance schools) have now signed the public petition. But Alliance administrators and their allies are doubling down on their efforts to thwart unionization. Beginning in late May, the California Charter Schools Association started to pay Alliance alumni to call parents at home, in an effort to drum up opposition to a union.

I don’t want to work for a machine that just cares about the growth and expansion of the organization,” says Molla. “Although [fighting for a union] is not an easy process, and can be exhausting, it really just shows these large organizations that we are the ones who make up this organization and that there needs to be that balance of power.”
